The Hersons filed suit in federal court, arguing that a provision in the city law restricting the size and timing of political signs was unconstitutional.
So its not Palin or the board itself but prob the size of the thing, they just dont do political billboards in that city.
Those restrictions are probably unconstitutional is what I am saying.
Still not sure if you can do political ads for someone who isn't an announced candidate. For example, could someone pay to put up a "Gramps for President in 2012" sign?
Also, I wonder if there is a specific problem with Palin because she works for what passes itself off to be a news organization. I thought there was some restriction about being in the media and running for political office at the same time.
I thought she would have to quit Fox News to run for office again.
yah, i can see how the law itself could be unconstitutional and over all not needed. I just dont think it had to do with it being a conservative candidate like the guy goes on about.
Good questions though on the laws of the ads, i wouldnt know.. This seemed like a city law issue though?
It is a zoning issue. A valid zoning ordinance can limit First Amendment speech rights.
Oh, okay, although it doesn't seem as if it should, especially when it comes to political speech, which is primarily what the First Amendment was designed to protect.
I know the other issues I raised are not connected to this narrow one, I just found them interesting. Do you have to be a candidate to have ads like that?
zoning in this case is just a excuse to bypass First Amendment rights due to being in flak town San Fransicko.
Instead of making stupid comments try learning the law.
Without reading the actual ordinance in question, I can't say whether it was valid or not. HERE is a decent short article that kind of explains it better than I can right now.
I think the guys who brought suit are just trying to put up billboards and make money. They are using the "political speech" angle in an attempt to get past a valid ordinance. The dad is a lawyer and we all know lawyers will do anything for a buck.
Not sure about the candidate issue.
It worked. This is the first I have heard of the results of our labors on this issue. We worked SF first as we knew it would be easy to establish a precedent. This is yet another step to slam shut the mouths of anyone opposing our ideas, the way it should be. Be sure to monitor and turn in your neighbors, per the BO program, any chance you get, to end this free speech insanity. As BO advises, the Constitution is a living document, subject to change and to be modified to follow foreign laws.
Gramps
While I am no Palin fan, I don't see how they can prevent this, unless it is because she isn't an officially announced candidate.
Seems like another serious breach of the First Amendment.
